Ek saath di gayi 3 talaaq 3 padti hain ya 1?
Agar kisi ne ek hi majlis me apni biwi ko 3 talaaq de diya to 3 talaaq maana jaaega ya 1?Is baare me hadiso se kya maloom hota hai aur Sahaba-e-Kiraam ka fatwa aur amal kya tha? Mukammal maloomat niche sawal aur jawab ki shakal me pesh hai.

Jawab:Ek majlis me ya ek tuhar (woh waqt jis me aurat ko haiz nahi aa raha ho)3 talaaq dena sakht najaaiz aur gunah hai.
Sawal:Jab ek majlis me 3 talaaq dena najaaiz hai.To agar koi shakhs apni biwi ko ek hi majlis me 3 talaaq de de to ek talaaq padegi ya 3?
Jawab:3 talaaq padegi.Kyunki us ka najaaiz hona alag hai aur us ka padna alag.Jaise Roze ki haalat me khaana aur pina sakht najaaiz aur gunah hai.Lekin agar koi khaa hi le to yaqinan us ka roza toot jaaega. Isi tarah ek majlis me 3 talaaq dena agarche najaaiz aur gunah hai. Lekin agar koi de hi de to teeno zarur pad jaaengi.
Sawal:Ek majlis me 3 talaaq dene se teeno talaaq pad jaaengi.Kya is par koi daleel hai?
Jawab:Is ke baare me bahut saari hadeesen hain jin se saaf saaf saabit hota hai ki teeno talaaq pad jaaengi.Un me se kuchh ye hain.
Hadis No.1:Hazrat-e-Sahal bin Sa’ad radhi allaho anho bayan karte hain ki:Hazrat-e-Owaimar radhi allaho anho ne Huzur Sallallaho alaihe wasallam ke saamne hi apni biwi ko 3 talaaq de diya to Huzur Sallallaho alaihe wasallam ne use 3 talaaq maana.

Hadis No.2:Hazrat-e-Aamir Sha’abi radhi allaho anho bayan karte hain ki:Main ne Fatima bint-e-Qais se kaha ki mujhe apne talaaq ke baare me bataaiye.To unhone kaha:Mere shauhar ne Yaman jaate waqt mujhe ek saath 3 talaaq de diya.To Huzur Sallallaho alaihe wasallam ne us ko 3 talaaq qarar diya.

Hadis No.3:Hazrat-e-Sawed bin gafla bayan karte hain ki:Aaisha khus’amiyaa Hazrat-e-Imam Hasan radhi allaho anho ki biwi thi.Aap ne un ko is tarah se talaaq di. “To chali jaa,Tujhe 3 talaaq.” Woh chali gayi.Baad me aap ko maloom hua ki woh aap ki judaai se bahut hi gamgin hai to aap bhi ro pade aur farmaya:Agar main apne nana jaan Huzur Sallallaho alaihe wasallam se ye nahi suna hota ki “Jis shakhs ne apni biwi ko 3 talaaq di alag alag tuhron me ya ek hi saath to woh aurat halaal nahi hogi jab tak ki kisi aur se nikah nahi kar le” to main use lauta leta.

In hadiso se ye maloom ho gaya ki agar koi shakhs apni biwi ko 3 talaaq de chaahe alag alag tuhron me ya ek saath ek hi majlis me. 3 diya hai to 3 hi padengi.Kyunki Huzur Sallallaho alaihe wasallam ne bhi use 3 hi maana aur isi ka hukm bhi diya.
Sawal:Is baare me Sahaba-e-Kiraam ka kya fatwa tha?
Jawab:Sahaba-e-Kiraam ka bhi yahi fatwa tha ki jab 3 diya hai to 3 hi padengi.Ek saath 3 de ya alag alag.
Sawal:Kya hadees sharif ki kitaabo me koi aisi riwayat hai jis se ye maloom hota ho ki Sahaba-e-Kiraam ka bhi yahi fatwa tha?
Jawab:Ji Haan! Bahut saari riwayaten hain.Un me se kuchh ye hain.
(1)Hazrat-e-Saalim bayan karte hain ki Hazrat-e-Abdullah bin Umar radhi allaho anhuma ne farmaya ki:Jis shakhs ne apni biwi ko 3 talaaq diya to woh teeno pad jaaengi,Lekin us ne aisa kar ke apne rab ki nafarmaani kiya.(Musannaf Abdur Razzaq,Hadees No.11344)
(2)Hazrat-e-Alqama kahte hain ki:Hazrat-e-Abdullah bin Mas’ood radhi allaho anho se sawal kiya gaya ki agar koi shakhs apni biwi ko 100 talaaq de de to?Aap ne farmaya ki 3 talaaqo se uski biwi us par haraam ho gayi aur baaqi 97 hadd se ziyadah hain.(Musannaf Ibn-e-Abi Shaiba,Hadis No.18098)
(3)Hazrat-e-Mujahid kahte hain ki Hazrat-e-Abdullah bin Abbas radhi allaho anho ne bayan kiya ki un se ek shakhs ne kaha:Aye Abu Abbas!Main ne apni biwi ko 3 talaaq de diya hai.Hazrat-e- Abdullah bin Abbas radhi allaho anho ne (Tanz)Karte hue farmaya ki:Ya abaa Abbas!Phir aap ne farmaya ki tum me se koi shakhs bewaqoofi se apni biwi ko talaaq de deta hai.phir aa kar kahta hai:Aye Abu Abbas! To suno!Tum ne apne rab ke hukm ke khilaaf kiya aur tumhari biwi tum se alag ho gayi.(Musannaf Abdur Razzaq,Hadis No.11352)
(4)Hazrat-e-Waaqe bin Sahban bayan karte hani ki Hazrat-e-Imran bin Husain radhi allaho anho se sawal kiya gaya ki:Ek shakhs ne apni biwi ko ek saath 3 talaaq de diya to us ka kya hukm hai?Hazrat-e-Imran bin Husain radhi allaho anho ne farmaya ki us ne apne rab ke hukm ke khilaaf kiya aur us ki biwi us par haraam ho gayi.( Musannaf Ibn-e-Abi Shaiba,Hadis No.18087)
(5)Hazrat-e-Anas radhi allaho anho bayan karte hain ki:Jab Hazrat-e-Umar radhi allaho anho ke paas koi aisa shakhs laaya jaata jis ne apni biwi ko ek hi majlis me 3 talaaq diya ho.To aap us ko maarte aur un ke darmiyan judaai kar dete.( Musannaf Ibn-e-Abi Shaiba,Hadis No.18089)
Upar bayan kiye gaye, Huzur Nabi kareem Sallallaho alaihe wasallam aur Sahaba-e-kiraam ke farmaan ko padhne ke baad ek musalman ka imaani taqaaza hota hai ki woh Huzur Sallallaho alaihe wasallam aur Sahaba ki baaton ko maan le.Kyunki nijaat in sab ko maan ne hi me hai.Lekin agar koi shakhs Huzur aur Sahaba ki bhi baat ko thukra kar apne dimaag me base hue baaton hi par zidd karta rahe to ye us ka apna maamla hai .Dusra khair-khaahi ke elawah aur kya kar sakta hai.

Is riwayat se to maloom hua ki Huzur ke zamaane me 3 talaaq ko ek hi talaaq maana jaata tha.Is ka kya jawab hai?
Jawab:Huzur ne apne zamaane me kya kiya aur Sahaba ne kya fatwa diya karte the upar tafseel se bayan ho chuka.Rahi baat is hadees ki to agar is ko sahi maan liya jaae to Hazrat-e-Umar radhi allaho anho par ye ilzaam aata hai ki unhone jaan bujh kar Huzur ke tariqe ko badla aur Huzur ke khilaaf kiya aur Sahaba ne us ko qabool bhi kar liya.Kya koi Musalman Hazrat-e-Umar aur Sahaba ke baare me aisa soch bhi sakta hai?Hargiz nahi.Yahi wajah hai ki tamaam fuqhaa-e-Islam ne is riwayat ko sahi nahi maana.Dusri baat ye ki is riwayat me ye bataya gaya ki Hazrat-e-Abdullah bin Abbas radhi allaho anhuma ne ye kaha ki Huzur ke zamaane me 3 talaaq ko ek hi maana jaata tha.Jab ki khud Hazrat-e-Abdullah bin Abbas radhi allaho anhuma ye fatwa dete the ki 3 talaaq 3 hi hoti hain jaisa ki upar bayan hua.
Allama ibn-e-Hajar Asqalaani likhte hain ki: Hazrat-e-Abdullah bin Abbas radhi allaho anhuma ke baare me ye gumaan nahi kiya jaa sakta hai ki woh Huzur Sallallaho alaihe wasallam se kisi baat ki riwayat kare aur fatwa us ke khilaaf de.Is liye ye riwayat etebaar ke qaabil nahi.Aur Hazrat-e-Ibn-e-Abbas ki taraf is riwayat ko mansoob karne me Taa’Oos se galti hui hai.(Fatahul Baari,Vol:9,Page No.363)
Gair-muqallido ke mash’hoor Aalim Qazi Shaukani likhte hain ki:Imam Ahmad bin Hambal ne farmaya ki Hazrat-e-Ibn-e-Abbas ke tamaam shaagirdo ne hazrat-e-Ibn-e-Abbas se Taa’Oos ke khilaaf riwayat kiya hai.(Nilul Autaar,Vol:8,Page No.22)
Ab aap soche ki jin se ye hadees marwi hai woh khud is par amal nahi karte to dusra kaise kar sakta hai.Woh bhi us waqt jab ki dusri saaf aur Sahi hadiseesen maujood ho.
Aakheri baat! Is me koi shak nahi ki Huzur Sallallaho alaihe wasallam ki baat se badh ke kisi ki baat nahi.Lekin ye kaunsi Sahi hadees me hai ki Aap Sallallaho alaihe wasallam ne farmaya ki “3 talaaq 3 nahi balki ek hoti hai.” Agar Sahi Muslim ki is riwayat ke baare me kahe to ek baar aap us ko phir gaur se padh le.Is me Huzur ka apna koi farmaan hi nahi hai.To kyun nahi ham us hadees par amal kare jis me aap Sallallaho alaihe wasallam ka farmaan saaf saaf likha hua hai.Aur khaas kar ke us waqt jab ki ye hadees sahi bhi nahi hai.Aur hadees ki riwayat karne wale sahabi ka fatwa bhi us ke khilaaf hai.
Sawal:Kuchh log kahte hain ki Hazrat-e-Rukaana radhi allaho anho ne apni biwi ko 3 talaaq diya us ke baad bhi Huzur Sallallaho alaihe wasallam ne aap ki biwi ko aap ki taraf lauta diya.Is se to ye maloom hota hai ki ek saath 3 talaaq dene se 3 nahi balki ek hi hota hai. Kyunki agar 3 hota to Aap Sallallaho alaihe wasallam un ki biwi ko un ki taraf nahi lauta te.Is ka kya jawab hai?
Jawab: Hazrat-e-Rukaana radhi allaho anho ne apni biwi ko lafze “Batta” keh kar talaaq diya tha.Jis ka maana arbi zubaan me ek talaaq bhi hota hai aur teen bhi.Isi wajah se Jab Hazrat-e-Rukana radhi allaho anho talaaq de kar Huzur Sallallaho alaihe wasallam ke paas pahunche to Aap Sallallaho alaihe wasallam ne un se puchha ki tum ne ye lafz bol kar kya muraad liya tha (Ek ya teen)To unhone kaha ek.Tab huzur Sallallaho alaihe wasallam ne un ki biwi un ki taraf lauta di.(Ibn-e-Maja,Hadis No.2051.Abu’dawood,Hadis No.2206.2208)
Is hadees se to saaf maloom hota hai ki Aap Sallallaho alaihe wasallam ek saath di gayi 3 talaaq ko 3 hi maante the.Kyunki agar Aap Sallallaho alaihe wasallam 3 talaaq ko ek hi talaaq maante hote to phir aap ko hazrat-e-Rukaana se un ki niyat puchhne ki zarurat hi nahi padti.
Aakhir me ek baat aur yaad rakhe!Imam Ahmad ne apni hadis ki kitaab “Masnad-e-Ahmad” me Hazrat-e-Rukaana ki jis riwayat ko likha hain us me 3 talaaq ka lafz aaya hai.Magar woh riwayat Abu’dawood ki sahi hadees ke khilaaf hone ki wajah se za’eef hai.Is liye us riwayat ko dalil banana durust nahi hai.
Ummid hai ki aap khoob achhchhi tarah is mas’ale ko samajh gae honge.Aur ziyadah maloomat ke liye aap khud Hadees ki kitaabo ka mutaala kare.Allah Ta’ala ham sab ko sidhe raaste par chalaaye.
