Court marriage ka shara’ee hukm kiya hai?

Sawal:Kuchh log apni pasand ki ladki ke saath court marriage kar lete hain.aur miya biwi ban ke rehte hain.Puchhna ye hai ki court marriage karna sahi hai ya galat?Aur court ke zariye ki gayi shadi ka Islam mein etebaar hai ya nahi?

Jawab:Islam mein har baalig ladke aur ladki ko apni pasand se shadi karne ka ekhtiyaar hai.Allah ta’ala Quran sharif mein irshad farmata hai. فَانکِحُوۡا مَا طَابَ لَکُمۡ Tum un (Musalman) auraton se nikah karo jo tumhe pasand aae.(Surah Nisa,Aayat No.3)

Lekin is ekhtiyaar dene ke saath saath Islam ne shadi biyah karne ke taur tariqe bhi bataya hai.Jis ki paabandi karna har musalman mard aur aurat par zaruri hai.Chunancha Nikah ke sahi hone ke liye do bunyadi shartein(Basic conditions) hain.Pehla ladka aur ladki ka ijaab aur qabool karna.Yani ek ka ye kehna ki “Main ne tum se nikah kiya” aur dusre ka ye kehna ki “Main ne qabool kiya”.Ya isi tarah ka koi aur jumla bolna.Jaisa ki Bada-e-wassanae mein hai. “Nikah ke sahi hone ki shart ijaab aur qabool hai.

Aur dusra. kam se kam do gawaho ka hona.Jaisa ki Huzur Nabi kareem Sallallaho alaihe wasallam ne farmaya ki:Nikah do gawaho ke zariye hi hota hai.(Bada-e-wassanae,Kitabun nikah)

Ab ye dekha jaaega ki court marriage is tariqe ke mutabiq hota hai ya nahi.Agar isi tarah se hota hai to nikah bilkul sahi hoga aur agar nahi to us nikah ke sahi hone ka koi sawal hi paida nahi hota.

Ek judge ke batane ke mutabiq “Court marriage” ka matlab India ke qaanoon mein ye hai ki court marriage ke zariye shadi karne wale ladke aur ladkiyan kisi mazhab ke maan-ne wale nahi hain.agar kisi mazhab ke maan ne wale hain to woh apne society mein apne taur tariqe ke mutabiq shadi kare.Court aise logo ko shadi karne ki ijaazat nahi deta hai.

Agar sahi mein aisa hai to shadi hone aur na hone ki baat alag woh imaan hi se nikal jaata hai.Kyunki us ne “Court marriage” kar ke ye zaahir kar diya ki ham kisi mazhab ke maan ne wale nahi.

Dusri baat court mein Ijaab aur qabool bhi nahi hota.Sirf ladka aur ladki apne baalig hone ka suboot dete hue court se guzarish karte hain ki ham baalig aur khud mukhtaar hain aur begair kisi dabao ke miya biwi ban ke rehna chahte hain.Is liye hamari darkhast qabool ki jaae. Phir court ka Haakim qanooni kaarwa’ee aur jaanch ke baad dono ko miya biwi maante hue “Marriage Certificate” de deta hai.Jab ki begair Ijaab-o-qabool aur gawaho ke sirf kisi ke ijaazat de dene se nikah hargiz nahi hota hai.Shari’at ke etebaar se in kharabiyo ki wajah se “Court marriage” karna bilkul durust nahi hai.

Allah aur us ke Rasool sahi baat ko sab se zyada jaan ne wale hain.
